New York Summons and Complaint tab

In New York, a divorce action begins with a Summons with Notice, or a Summons and Verified Complaint. When filed with the Supreme Court in the appropriate county, this document initiates the divorce proceeding with the court.

The case is filed in the Supreme Court in the county where you or your spouse lives.

Residency

To file for divorce in New York you must meet one of the following residency requirements:

  • You or your spouse have lived in New York State continuously for at least two years immediately before you start the action; or
  • You or your spouse are living in New York State when you start the action and have lived here continuously for at least one year immediately before, and either your marriage ceremony took place in New York State or you lived in New York State together as a married couple; or
  • You or your spouse have lived in New York State continuously for at least one year immediately before you start the action, and the grounds for your divorce arose in New York State; or
  • You and your spouse are both New York State residents when you start the action, and the grounds for your divorce arose in New York State.

Grounds

Most uncontested divorces in New York proceed on the no-fault ground: that the relationship between the spouses has broken down irretrievably for a period of at least six months.

Filing does not legally end the marriage. In order to finalize and complete a divorce, a judge must sign a Judgment of Divorce. Once your spouse has been served, they have 20 days to respond if they were served within New York State.

A case may be discontinued before the judgment is signed, though the steps required depend on how far the case has progressed.
